BCA Business Check your route
Website terms, and how we engage

Terms

Two different things live on this page. The first governs your use of this website. The second describes the terms on which we take on work — which are agreed in a signed engagement letter, not by you reading this.

Part one

Using this website

This site is published by BCA Business Ltd, company number 16606602, registered in England and Wales at 128 City Road, London EC1V 2NX. By using it you accept the terms in this part.

The content is information, not adviceImportant
Everything here describes what regulators have published. It is not regulatory, legal, tax or financial advice, it is not tailored to your product, and no reader becomes a client by reading it. Decisions about a specific product need a specific engagement.
It is accurate on the date shownAnd not after
Every page carries the date we last checked its sources. Fee schedules, review periods, reference lists and guidance versions change without notice, sometimes retrospectively. A figure that was right in September may be wrong in March, and the date on the page is how you tell.
Use it, cite it, do not pass it offCopyright
The text, tables, diagrams and interactive tools are our copyright. You may read, print and quote from them for your own business purposes with attribution and a link. You may not republish substantial parts, resell them, or present them as your own work or your own research.
The tools are estimatesCalculators
The cost estimate and the route checker compute from published official fees and from the assumptions stated beside them. They produce an indication, not a quotation, and they cannot see your file. Nothing either tool outputs binds us.
Links out are not endorsementsThird parties
We link to regulators, legislation and official registers so you can check us. We do not control those sites and are not responsible for their content or availability.
AvailabilityNo guarantee
We aim to keep the site up and correct, and we do not promise it will be uninterrupted or error-free. We may change, move or withdraw any page at any time.

Liability, stated plainly. We accept no liability for loss arising from reliance on this website alone, because nothing on it is advice about your product. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Liability arising out of an engagement is dealt with in the engagement letter for that engagement, not here.

Part two

How an engagement actually works

These are the standing terms behind every piece of work. They are repeated in the engagement letter, which is the document that governs, and which is signed before anything starts.

What is always true

  • Scope, fee and milestones are agreed in writing before work begins
  • Official fees, representative licences, translation, legalisation, testing and inspections are passed through at cost, with the receipt
  • No percentage of your revenue, no royalty, no success fee
  • No commission from any representative, distributor or test house we introduce
  • You own every document we produce, including if you take it to another provider
  • A mutual non-disclosure agreement is signed before you send us anything

What we will not do

  • Guarantee an approval, a date, or a particular regulator's decision
  • Hold a marketing authorisation or act as your authorised representative ourselves
  • Perform conformity assessment, laboratory testing, clinical investigations or bioequivalence studies
  • File a dossier we know to be incomplete in order to meet a date
  • Act where doing so would put us in conflict between two clients in the same market
PaymentTerms
The route assessment is invoiced before the kickoff call. Projects are billed at agreed milestones and never wholly in advance. Invoices are payable within 14 days. We are not currently VAT registered, so no VAT is charged on our fees.
StoppingEither side
You may stop a project at any point. You pay for milestones completed and nothing further, and everything produced to that point is handed over. We may decline to continue where we are asked to act in a way we consider wrong, and we will say so in writing before we do.
Your obligationsWhat we rely on
That the documents and information you give us are accurate and complete, that you hold the rights to the product, and that you tell us about anything already filed in a target market by anybody. A dossier built on an incomplete account of what already exists is the most expensive avoidable problem in this work.
ConfidentialityBoth directions
Mutual, and it survives the engagement. We do not name clients, products or markets in marketing without written permission, and we do not use a case as an example even anonymously where it could be identified.
Governing lawJurisdiction
These terms and any engagement are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
Complaints

If something goes wrong

Tell us first, by email to mail@bcabusiness.co.uk or in writing to the registered office. We acknowledge within three working days and respond substantively within fifteen. If the complaint concerns personal data rather than the work, the route is set out in the privacy notice, and you may go to the regulator without coming to us first.

Changes to these terms. We may update this page. The version that applies to your engagement is the one in force when the engagement letter was signed, and a later change here does not alter it.

Ask before you sign, not after

If a term here would be a problem for your legal team, raise it at the first call. Most of what is above is negotiable in an engagement letter; a small part of it is the reason the business works the way it does.
